These Terms and Conditions govern your use of Tago, a peer-to-peer vehicle rental platform operated in the Republic of El Salvador by TAKE AND GO, SOCIEDAD POR ACCIONES SIMPLIFICADA DE CAPITAL VARIABLE (TAGO, S.A.S. DE C.V.), a Salvadoran company registered with the Commercial Registry of the National Registry Center under entry 152 of book 4942 of the Companies Registry, business registration No. 126, book 512, effective March 10, 2026, with registered office at Avenida Jacarandas 175, Colonia Miramonte, San Salvador. By creating an account, accessing the Services, or confirming a Booking, you acknowledge that you have read, understood, and accepted these Terms in full, including the documents incorporated by reference. If you do not agree with any condition, please do not use the Services. The Spanish version at tago.rent/es/legal/terms-of-service is the legally authoritative version.
1. Parties and definitions
"Platform" or "Services" — the website, mobile application, and all digital services operated by Tago.
"User" — any natural person over 18 who creates an account.
"Host" — User who owns or legitimately possesses a vehicle and makes it available to others.
"Guest" — User who books and uses a vehicle through the Platform.
"Booking" — the binding agreement between Host and Guest for use of a specific vehicle.
"Tago Commission" — the percentage of the Trip Price retained by Tago as consideration for the intermediation.

2. Acceptance and legal capacity
To register and use the Services, you represent that you:
- Are a natural person over 18 with full legal capacity per Art. 1316 of the Civil Code of El Salvador.
- Are not disqualified by judicial or administrative resolution.
- Have provided truthful, accurate, and current registration information.
- Will use the Services only for lawful purposes.
Tago acts exclusively as a technology intermediation platform. Tago is not a party to the rental agreement between Host and Guest, which is governed by Arts. 1703 et seq. of the Civil Code.
Tago reserves the right to modify these Terms. Material changes will be notified at least 15 days before they take effect.
3. Registration and identity verification
To access the Services you must create an account providing full name, email address, phone number, and password. Each natural person may maintain a single account.
Tago implements an identity verification process that may include presentation of DUI, passport, or other official document; valid driver license for the vehicle category; facial biometric verification (with express consent); and verification of phone and email.
Tago may suspend or cancel an account when these Terms are breached, false information is provided, there are signs of fraudulent activity, or required by a competent authority. Cancellation does not relieve the User from pending obligations.
4. Conditions for Hosts
The Host represents and warrants that the vehicle:
- Is owned by them or they have written authorization from the owner.
- Has a valid circulation card and current marchamo (annual road tax).
- Is in good mechanical condition and safe.
- Is not subject to litigation, liens, or encumbrances that prevent its rental.
The Host undertakes to maintain the vehicle in optimal condition, deliver it with the agreed fuel level and original documents available, keep availability up to date, and honor confirmed Bookings. The Host complies with all tax obligations arising (Tax Code and Income Tax Law).
It is forbidden for the Host to publish vehicles with irregular documentation, demand payments outside the Platform, discriminate against Guests, or install undisclosed tracking or surveillance devices.
For each completed Trip, Tago retains a service commission whose percentage is shown in the Host panel. The net balance is transferred to the registered payment method within the timeframe established in the payment policies.
5. Conditions for Guests
To book, the Guest must be over 18, have completed identity verification, hold a valid driver license for the vehicle category (issued at least one year before the Trip), and have a valid registered payment method.
During the Trip, the Guest undertakes to:
- Drive the vehicle personally and not transfer it to unauthorized third parties.
- Comply with the Land Transport, Traffic, and Road Safety Law (Decree 477/1995).
- Not drive under the influence of alcohol or other substances.
- Immediately report any accident, damage, or incident.
- Not smoke inside the vehicle.
- Not transport illegal substances or commercial cargo.
- Not leave Salvadoran territory without written authorization from the Host and Tago.
- Return the vehicle with the same fuel level, or pay the equivalent.
It is forbidden to sublease the vehicle, participate in races or high-risk activities, modify the vehicle, tow other vehicles, or make payments to the Host outside the Platform.
6. Bookings, prices, and payments
The Booking is perfected when the Host accepts the request (or, in instant bookings, when payment is confirmed). At that moment a chattel rental contract arises between Host and Guest (Art. 1703 of the Civil Code).
The Trip Price includes base fare, Tago service commission, optional add-ons (delivery, additional kilometers, fuel, washing), and security deposit.
Prices are expressed in U.S. dollars (USD), legal tender in El Salvador (Monetary Integration Law). All prices shown to the Guest include 13% VAT (Art. 3 of the VAT Law).
Payments are processed through the processor enabled by Tago. Tago does not store card data; these are processed by PCI-DSS certified providers. Tago does not accept cash payments between Host and Guest for Booking-related concepts.
The Host is responsible for declaring and paying the taxes corresponding to their rental income (ISR and VAT when applicable). Tago may issue income reports to facilitate compliance.
7. Cancellations and refunds
The detailed cancellation policy is at tago.rent/legal/cancellation-policy and forms part of these Terms.
General principle: Tago's service commission is not refunded in cancellations initiated by the Guest or in force majeure events. The commission is only refunded when cancellation is initiated by the Host or by Tago.
Summary of base rental refund:
- Guest cancels more than 48 hours before start: 100% of base price.
- Guest cancels between 24 and 48 hours before: 50% of base price; remaining 50% credited to Host as compensation for blocked availability.
- Guest cancels less than 24 hours before: 0% of base price; full amount credited to Host.
- Guest no-show (>30 minutes after scheduled start): 0%; insurance and roadside assistance not refunded.
- Host cancellation: 100% of all amounts to Guest (including Tago commission); Host subject to cancellation fee of $25 if more than 24 hours notice, $50 if less, and $150 for no-show.
- Tago cancellation (safety or policy): 100% of all amounts to Guest.
Insurance and unused add-on services are refunded at 100% in all Guest cancellations except no-show.
8. Vehicle damage and security deposit
Both Host and Guest must document the vehicle's condition at the start and end of each Trip via photos uploaded to the Platform. This documentation has evidentiary value.
The Guest is liable for material damages attributable to their conduct or negligence per Arts. 2065 et seq. of the Civil Code on extracontractual liability: collision, rollover, improper use, driving under the influence, loss or damage of accessories, stains or odors requiring special cleaning.
To claim damages, the Host must report them to Tago within 24 hours of return, attaching photos, repair quote or invoice, and statement of facts. Tago will mediate but does not guarantee a specific outcome.
At the start of each Trip, Tago temporarily holds a security deposit. This deposit is released after confirming the return in agreed conditions. In case of damage, Tago may debit the corresponding amounts from the deposit upon prior notice.
Every Trip is backed by a policy issued by La Central de Seguros y Fianzas, S.A., regulated by the Superintendencia del Sistema Financiero (SSF). The Guest selects the coverage level when confirming the Booking; the deductible corresponds to the selected level.
9. Prohibited conduct
Users may not:
- Use the Platform for unlawful activities (Penal Code, Special Law Against Computer and Related Crimes).
- Publish false, defamatory, discriminatory content or content that violates third-party rights.
- Bypass or manipulate rating, verification, or payment systems.
- Harass, intimidate, or threaten other Users.
- Create multiple or fake accounts.
- Reverse engineer or introduce malicious code.
- Arrange direct rentals to avoid Platform commissions.
Breach may result in suspension or permanent cancellation of the account, retention of pending payments, claim of damages, and reporting to competent authorities.
10. User content and intellectual property
By posting listings, photos, ratings, or any content on the Platform, the User grants Tago a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, and distribute such content to operate and improve the Services.
The User warrants that their content is truthful and does not infringe third-party intellectual property, image, or privacy rights.
Tago operates a reciprocal rating system. Ratings must be honest and based on real experience. Manipulation or purchase of ratings is forbidden.
The Platform, its software, design, logos, trade name, and database are exclusive property of Tago or its licensors. Any unauthorized use of Tago marks may constitute an infringement registrable before the Centro Nacional de Registros (CNR).
11. Limitation of liability
Tago does not assume direct liability for: the mechanical condition of listed vehicles; the accuracy of information published by Hosts; User behavior during the Trip; traffic accidents or fines during the Trip; loss of personal belongings left in the vehicle by the Guest; damages to third parties caused by the Guest while driving.
Under no circumstances will Tago's total liability to a User exceed the total service commissions paid by that User to Tago in the 12 months prior to the event.
These limitations do not apply in case of willful misconduct or gross negligence by Tago, nor where Salvadoran consumer protection legislation prohibits such exclusions.
12. Dispute resolution
For any dispute between Host and Guest related to a Trip:
Step 1 — Direct communication via the Platform messaging system within 48 hours of the event.
Step 2 — Tago mediation: either party may escalate the dispute to hola@tago.rent within 5 calendar days of the Trip, attaching documentation.
Step 3 — Tago resolution: the Tago team will issue a non-binding resolution within 10 business days of receiving all documentation.
If internal resolution does not satisfy the parties, they may resort to the Mediation Center of the Ministry of Justice, the Arbitration and Mediation Center of the Chamber of Commerce and Industry (CCIES), or the competent civil and commercial courts.
Consumer Users have the right to file complaints with the Consumer Defense Office (defensoria.gob.sv · Tel. 910), per the Consumer Protection Law (Decree 776/2005).
13. Privacy and data protection
Processing of your personal data is governed by Tago's Privacy Policy, available at tago.rent/legal/privacy-policy, which forms an integral part of these Terms and has been prepared in accordance with the Personal Data Protection Law (Decree 144/2024).
You may exercise your ARCO-POL rights (Access, Rectification, Cancellation, Opposition, Portability, Erasure, and Limitation) by writing to privacy@tago.rent.
14. Governing law and jurisdiction
These Terms and any dispute related to Tago's Services in El Salvador will be governed and interpreted under the laws of the Republic of El Salvador, including:
- Civil Code (rental and contracts)
- Commercial Code
- Consumer Protection Law (Decree 776/2005)
- Personal Data Protection Law (Decree 144/2024)
- Cybersecurity and Information Security Law
- Land Transport, Traffic, and Road Safety Law (Decree 477/1995)
- Special Law Against Computer and Related Crimes
- Tax Code and Income Tax Law
The parties expressly submit to the jurisdiction of the civil and commercial courts of San Salvador, waiving any other venue.
15. Final provisions
Entirety: these Terms, together with the Privacy Policy and Cancellation Policy, constitute the complete agreement between Tago and the User regarding the Services.
Severability: if any clause is declared null or unenforceable, the remaining clauses will remain in full force.
Assignment: the User may not assign their rights without prior written consent of Tago. Tago may assign its rights to any subsidiary, affiliate, or in the context of a merger, acquisition, or sale of assets, notifying the User with reasonable advance notice.
Notices: Tago notices to the User will be sent by email to the address registered in the account or via notice on the Platform. User notices to Tago must be sent to legal@tago.rent.
Language: the official and binding version of these Terms is the Spanish version. In case of discrepancy with any translation, Spanish prevails.
